Primary license terms for PGStyx.

1. Definitions

In this license:

Software
PGStyx in object code or binary form, including official JAR distributions made available by or on behalf of the Licensor.
Licensor
Teodor-Bogdan Barbieru, the copyright holder of the Software.
Seller
Boggio Analytics, the entity handling commercial licensing, ordering, and account communication for PGStyx.
Licensee
The person or organisation obtaining, installing, accessing, or using the Software.
Organisation
A single legal entity using or licensing the Software. Parents, subsidiaries, affiliates, and sister companies are not included unless expressly listed in the applicable order, invoice, quote, or separate written agreement.
Community Features
The features designated by the Licensor as Community for the relevant Software release.
Commercial Features
The features designated by the Licensor as Pro or Enterprise for the relevant Software release.
License Key
A key or other activation credential issued by the Licensor or Seller to unlock Commercial Features.

2. License Grants

2.1 Community License Grant

Subject to this license, the Licensor grants the Licensee a free, non-exclusive, non-transferable license to use, copy, deploy, and integrate the Community Features of the Software for internal, client-facing, commercial, and non-commercial use.

2.2 Pro License Grant

Use of Pro Commercial Features requires a valid License Key issued for the Licensee Organisation or a separate written agreement. Unless a separate written agreement states otherwise, a Pro license purchased on a one-time per Organisation basis is perpetual for that Organisation with respect to the Pro Commercial Features made available under the corresponding purchase, invoice, or key issuance.

2.3 Enterprise License Grant

Use of Enterprise Commercial Features requires a valid License Key issued for the Licensee Organisation and may also be subject to a separate written agreement. Unless a separate written agreement states otherwise, an Enterprise license purchased on a one-time per Organisation basis is perpetual for that Organisation with respect to the Enterprise Commercial Features made available under the corresponding purchase, invoice, agreement, or key issuance.

2.4 Support Boundary

This license governs software use only. Support commitments, response times, service levels, update obligations, or other services exist only if stated in a separate written agreement.

3. Restrictions

  1. The source code of the Software is not provided under this license. No right to receive, redistribute, publish, or sublicense the source code is granted by this page.
  2. The Software may not be reverse-engineered, decompiled, or disassembled except to the extent such restriction is expressly prohibited by applicable law.
  3. Except for ordinary internal copying, deployment, and integration required for permitted use, the Software may not be redistributed, resold, sublicensed, repackaged, or made available as a standalone product without prior written consent of the Licensor.
  4. The Licensee may not bypass, disable, interfere with, or attempt to circumvent any License Key validation or Commercial Feature gating mechanism in the Software.
  5. The Licensee may not use the names "PGStyx", Teodor-Bogdan Barbieru, or Boggio Analytics, or any associated logos or marks, to imply endorsement, partnership, certification, or sponsorship without prior written consent.

4. License Keys and Commercial Activation

License Keys are issued per Organisation by the Licensor or Seller. A License Key may be delivered manually or electronically and may be accompanied by an invoice, quote, order confirmation, or separate written agreement describing the scope of the corresponding Commercial Features.

License Keys must not be shared outside the licensed Organisation, published, sold, transferred, or used to activate Commercial Features for any unrelated third party. Use of Commercial Features without a valid License Key or separate written agreement is not permitted and constitutes a breach of this license.

For Commercial Features, the Licensor or Seller may, upon reasonable prior written notice and not more than once in any twelve-month period, request a written certification from an authorised representative of the Licensee Organisation confirming that use of the Software and any issued License Keys complies with this license. The Licensee will respond to such a request within thirty (30) days.

Commercial licensing and account communication for PGStyx are handled by Boggio Analytics. Licensing inquiries should be sent to info@pgstyx.com. Current ordering and refund terms are described on the Terms and Refunds pages.

5. Termination

This license terminates automatically if the Licensee breaches any material term of this page and does not cease the non-compliant conduct promptly after notice from the Licensor or Seller.

Upon termination, the Licensee must stop using the affected Commercial Features and destroy or disable any related License Keys. If the Licensee remains in compliance with Section 2.1, use of Community Features may continue under the Community grant.

Sections 3, 5, 6, 7, 8, and 9 survive termination. Unless a separate written agreement states otherwise, termination for breach does not create any refund obligation beyond the public refund policy or any separate written agreement that expressly says otherwise.

6. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

7. Limitation of Liability

IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OF OR OTHER DEALINGS IN THE SOFTWARE.

8. Intellectual Property

The Software is licensed, not sold. All right, title, and interest in and to the Software, including all intellectual property rights, remain with the Licensor and, where applicable, its licensors.

No ownership interest, patent license, trademark license, or other implied right is granted except to the limited extent expressly stated in this license. Feedback, issue reports, and suggestions provided by the Licensee may be used by the Licensor and Seller without restriction or obligation.

9. General Provisions

  1. This page is the primary public license for the Software unless a separate written agreement applies to the relevant Commercial Features or transaction.
  2. If a separate written agreement between the Licensee and the Licensor or Seller conflicts with this page, that separate written agreement controls for the subject matter it covers.
  3. Updates to this license page apply to future releases after publication. Earlier releases continue under the license terms that accompanied or referenced those releases, unless a separate written agreement provides otherwise.
  4. The Licensee will comply with all applicable export control, sanctions, trade, and re-export laws and regulations in connection with the Software.
  5. The Licensee may not assign or transfer this license, whether by operation of law or otherwise, without prior written consent of the Licensor or Seller, except to a successor that acquires substantially all of the business or assets to which the Software relates, provided that the successor agrees in writing to be bound by this license and the Licensee gives prompt written notice of the transfer.
  6. This license, and any non-contractual disputes arising out of or in connection with it, are governed by the laws of Romania, excluding conflict-of-law rules.
  7. The competent courts of Romania have exclusive jurisdiction over disputes arising out of or in connection with this license, unless a separate written agreement provides otherwise.
  8. If any provision of this license is held unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by applicable law.
  9. The Software may include or depend on third-party components that are subject to their own license terms. This license does not limit the Licensee's rights or obligations under those third-party licenses.
